CHAPTER 155 Shade Tree Commission
155.01 CREATION AND ESTABLISHMENT.
There hereby is created and established the Youngstown Shade Tree Commission for the City which shall consist of seven members, citizens and residents of the district who shall be appointed by Council, one member representing each of the seven wards. The Commission shall have the right to call in consultants as they see fit. The Mayor and/or his representative shall be an ad hoc member. The City Park Department Forester shall be an ex officio member.
155.02 TERMS OF OFFICE.
The term of the seven persons to be appointed by the Councilpersons shall be three years except that the term of three of the members appointed to the first Commission shall be for only one year and the terms of two members of the first Commission shall be for two years. Successors to those members appointed by the Councilpersons shall thereafter be appointed for terms of three years. In the event that a vacancy shall occur during the term of any members, his successor shall be appointed for the unexpired portion of the term. If after thirty days’ notice, a new member is not appointed by the respective City Councilpersons, the Mayor shall appoint the replacee.
155.03 COMPENSATION.
Members of the Commission shall serve without compensation.
155.04 POWERS AND DUTIES.
The Commission shall have power to study, investigate, plan, advise, report and recommend to the Park and Recreation Commission any action, program, plan on which the Commission shall find or determine to be necessary or advisable for the care, preservation, trimming, planting, replanting, removal or disposition of trees and shrubs in public ways and public areas.
155.05 DUTIES AND RESPONSIBILITIES.
It shall be the responsibility of the Commission to study, investigate, counsel and develop and/or update annually and administer a written plan for the care, preservation, pruning, planting, replanting, removal or disposition of trees and shrubs in parks, along streets and in other public ways and public areas. Such plan will be presented to the Park and Recreation Commission annually by the Youngstown Shade Tree Commission and upon their acceptance and approval shall constitute the official comprehensive City Tree Plan for the City of Youngstown, Ohio. The Commission, when requested by the Park and Recreation Commission, shall consider, investigate, make findings, report and recommend upon any special matter or question coming within the scope of its work.
155.99 PENALTY.
(a) No persons shall hereafter plant any tree or shrub upon any public way, public area, street or alley unless he or she shall have first obtained a permit in writing from the Park and Recreation Commission specifying the size, type, species and location on the public way, public area, street or alley of the tree or shrub to be planted.
(b) Any person violating the provision hereof shall be fined not more than twenty-five dollars ($25.00). All monies and fines collected for violation of this chapter shall be deposited in the City Treasury and transferred to the credit of the fund designated the "Park and Recreation Fund".
(c) The Park and Recreation Commission shall have the authority to deny a permit to any person who proposes to plant any tree or shrub upon a public way, public area, street or alley of a size, type or species found to be undesirable for the location proposed; or they may deny a permit to any person who proposes to plant any tree or shrub upon a public way, public area, street or alley if at a location found by the Commission to be a size or type unsuitable for planting of trees or shrubs.
