RESOLUTION NO. R-2004-
A RESOLUTION REPEALING AND REENACTING RESOLUTION NO. R-2004-11 TO ESTABLISH THE PUBLIC ART COMMISSION

WHEREAS, the City Council believes the public interest would be served by the creation of a Public Art Commission; and

WHEREAS, the City Council recognizes the need for a public art policy that improves and enhances public space within the City; and

WHEREAS, the City Council heretofore adopted Resolution R-2004-11 establishing the Public Art Commission on March 16, 2004, and subsequently directed that certain modifications to membership of the Commission be made; and

WHEREAS, the members of the Public Art Commission shall be appointed and the Commission shall operate in accordance with the “City of Durango Rules and Procedures” and may adopt additional rules and procedures of operation that are not inconsistent with said Rules and Procedures.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Durango, Colorado, in regular meeting assembled that:

1. There is hereby established the Public Art Commission.

2. The Commission shall be vested with the responsibility of advising the City Council with respect to all aspects of planning, programming, procurement, installation, operations, and maintenance of public art projects and artworks.

3. The Commission shall consist of five (5) voting members. The guidelines for selecting members shall be formal education and/or training in visual or performing arts and/or related experience or background in art.

4. The Public Art Commission will work in conjunction with the Parks and Forestry Board on public art projects and proposals to be located in city-owned parks or open space.

5. The Public Art Commission will work in conjunction with the Design Review Board on public art projects and proposals to be located in the Central Business District.

6. The ex-officio member: A representative from the City Manager's office shall be the non-voting ex-officio member.

7. The Public Art Commission shall fulfill the following duties and responsibilities:

(a) Encourage all appropriate City Departments to actively participate by considering artwork in future capital improvement projects budgets.

(b) Adopt criteria for review of artwork proposals and site selection for the city's public art program that are in addition to and consistent with the criteria set forth in this resolution.

(c) Review proposals for artwork for the city's public art program and recommend approval or disapproval to the city council of such proposals.

(d) Set priorities for any available funding by conducting a public art inventory and assessment of pre-existing city-owned public artworks, and by developing a public art master plan.

(e) Consider potential sites, review site proposals, and recommend to the city council for approval appropriate site selections for the placement and display of artwork for the city's public art program. Reviews of sites shall include the notification and/or involvement of all affected individuals in the nearby vicinity.

(f) Communicate policy to the Parks and Forestry Board and the Design Review Board, and work collaboratively with the Boards regarding public art in City parks and the Central Business District by meeting with the Boards every other year to conduct an audit of possible public art locations. Both Boards have the option of appointing a liaison to attend the Public Art Commission meetings.

8. Artwork and Site Selection:

(a) A proposal for public art may be made to the public art commission by any organization, club or business, any city official or employee, or any individual member of the public, by filing an application with the ex-officio staff member to be forwarded by the ex-officio staff member to the public art commission for review.

(b)The criteria for consideration of proposed artwork shall include, but is not limited to:

(1) Compatibility of the design with the immediate environment of the site.
(2) Appropriateness of the design to the function of the site.
(3) Preservation and integration of natural features for the project.
(4) Appropriateness of the materials and design (texture, color, line, shape and value) to the expression of the artist's concept.
(5) Permanence of structural and surface components.
(6) Extent to which the work represents the diverse influences, culture, heritage, and traditions that reflect the unique qualities of the City of Durango and the southwest Colorado region.

(c)The criteria for reviewing a proposed site for placement of artwork for the city's public art program includes, but is not limited to:

(1) Relationship of the site to the artwork in terms of the physical dimensions, social dynamic, local, historical and cultural character and surrounding context of the site, existing or planned.
(2) Public safety.
(3) Extent to which the site helps to improve the design of an area by emphasizing a particular location through landmarks, gateways and/or linkages to other parts of the community.
(4) Vehicular and pedestrian traffic patterns.
(5) Site design including landscaping, drainage, grading, lighting and seating considerations.
(6) Relationship of the proposed artwork to existing artworks within the vicinity of the site.
(7) Environmental impact such as noise, sound, light and odor.
(8) Public accessibility to the artwork.
(9) Impact on adjacent property owners' view.
(10) Impact on operational functions of the city.
(11) Potential to minimize vandalism.
(12) Cost of development.

9. Resolution R-2004-11 is hereby repealed in its entirety.

The Public Art Commission shall also perform such other duties and responsibilities as may be designated by the city council. To accomplish the duties set forth, the Public Art Commission shall meet as necessary, but at least bimonthly, to accomplish its duties and responsibilities
